Redundancies and termination of employment
Law expects employers to terminate employment for a good reason, fairly and give the employee procedural fairness in the termination process. Employers should carefully consider termination grounds and process before proceeding, to avoid a risk of employees’ claims. We can advise employers and employees on termination of employment, including with respect to employee entitlements and payments on termination.
Unfair dismissal is when an employee is dismissed from their job in a harsh, unjust or unreasonable manner. Some employees may be able to make an unfair dismissal claim (within 21 days of the date of dismissal). Advice obtained by a business before proceeding with dismissing an employee will minimise the risk to the business of an unfair dismissal claim.
