Compliance and requirements

Employment law is rapidly evolving and complex area of law, and businesses often find it difficult to keep up to date with compliance with all relevant requirements.  Workers, whether they are employees or external contractors likewise often do not fully know their rights and obligations.

Employment contracts

We can advise and assist you with respect to the following:

    Employment contracts

Preparing employment contracts and advising employers and employees on terms and conditions or employment and employment contracts.

    Employment law compliance

Advising you on employment law compliance of your business relevant to your circumstances, including with respect to obligations under the National Employment Standards, legislative framework of the Fair Work Act 2009 and modern awards, where applicable.

    Redundancies and termination of employment

Law expects employers to terminate employment for a good reason, fairly and give the employee procedural fairness in the termination process. Employers should carefully consider termination grounds and process before proceeding, to avoid a risk of employees’ claims.  We can advise employers and employees on termination of employment, including with respect to employee entitlements and payments on termination.

    Unfair dismissals

Unfair dismissal is when an employee is dismissed from their job in a harsh, unjust or unreasonable manner. Some employees may be able to make an unfair dismissal claim (within 21 days of the date of dismissal). Advice obtained by a business before proceeding with dismissing an employee will minimise the risk to the business of an unfair dismissal claim.

If you as an employer or an employee face a situation of potential or actual dismissal, please feel free to reach out to us.
