Do you have a Good Will?

We have been regularly coming across people who do not have a Will in Australia and do not really know why they should make a Will.  Wills and Estate law and practice in Australia is very complex and involved, and it differs from same in Europe and many other countries.  Many people, unfortunately, are not aware of how things work in Australia.

In attempt to address common misconceptions and to offer some guidance, we prepared Guide to Wills (English and Russian versions).  The Guide shows reasons for making a Will, reasons to re-consider already existing Will and addresses the most common (but mistaken) reasons for not having a Will.

Do You have Power of Attorney Suitable for You?

Many people do not have a power of attorney as they believe they do not need it, when in their circumstances they actually do need it.   Some fear to make a power of attorney because they do not fully understand what it all is about.    Yet others often mistakenly believe that a power of attorney they made overseas under the law of other country will work in Australia. 

We are also regularly approached by people asking for a power of attorney for their elderly parents, when it may unfortunately be too late to make it as their parents already have some loss of mental capacity.     

Making power of attorney suitable for you and your circumstances is much more than preparing and signing a simple form.   And you should not leave this important matter to some later stage of your life.

У многих людей нет доверенности (power of attorney), так как они считают, что она им не нужна, хотя фактически в их обстоятельствах доверенность им необходима.   Некоторые люди боятся составить доверенность, потому что не полностью понимают как доверенность работает в Австралии.     Другие часто ошибочно думают, что доверенность, составленная за пределами Австралии по законодательству другой страны, пригодна для Австралии.

К нам также часто обращаются люди за доверенностью для их пожилых родителей, когда, к сожалению, может быть уже поздно составлять доверенность ввиду потери ими в какой-то степени дееспособности.

Составление доверенности подходящей для Вас и ваших обстоятельств – это больше и вовлеченнее, чем просто заполнение и подписание формы.   Не оставляете это важное дело до достижения вами очень пожилого возраста.
